Introduction On July 1, 2020, the U.S. Department of Education regulations 34 CFR 668.43(a) (5) (v) and 34 CFR 668.43(c) went into effect. The regulations require certain disclosures by an educational institution with respect to its programs that are designed to meet or advertised as meeting educational requirements for professional licensure or certification required for employment in a particular occupation . State Authorization expects institutions to obtain necessary federal approvals, if any, before offering programs within the state. The federal regulations are intended to prevent students from studying for years to enter professions such as counseling, nursing, and teaching, only to realize upon graduation they do not meet state-level requirements for employment. For every program designed to meet the requirements of a specific professional license, institutions are now required to determine whether their curriculum does or does not meet the educational requirements of other states. If the institution has not yet made a determination, it must share this information with its students. Compliance with these regulations ensures a degree from one of Mississippi’s community colleges will be recognized and a student will be eligible to sit for licensure in states other than Mississippi. However, the requirements for licensure vary from state to state. Each community college in Mississippi is a member of the National Council for State Authorization Reciprocity Agreement (NC-SARA), which allows the community colleges to provide distance learning programs and coursework to residents of states other than Mississippi. NC-SARA membership, however, does not grant reciprocity or exempt the community colleges from state professional licensing requirements. As a result, licensing requirements in Mississippi may not be recognized as sufficient to obtain a license in any other state. The Final Federal Regulations for State Authorization were published in the Federal Register on November 1, 2019. These regulations became effective on July 1, 2020, and replaced the 2016 Federal Regulations for State Authorization. Staff members at each of the colleges should read the regulations in their entirety. • 34 CFR 600.2 - Definitions (State authorization reciprocity agreement) • 34 CFR 600.9(c) – State Authorization (for distance education) • 34 CFR 668.43(a)(5)(v) – Institutional Information (public notifications for programs leading to professional licensure or certification for all modalities) • 34 CFR 668.43(c) – Institutional Information (individualized notifications for programs leading to professional licensure or certification for all modalities) On April 12, 2022, the Mississippi community colleges agreed to collaborate, where applicable, to reduce duplication of effort and to ensure system-wide compliance with federal laws, regulations, and the State Authorization Reciprocity Agreement. The following is a result of this effort.

Professional Licensure The U.S. Code of Federal Regulations, specifically 34 CFR 668.43(a) (5) (v) and 34 CFR 668.43(c), require disclosures by institutions regarding educational requirements for programs leading to professional licensure or certification regardless of modality. 34 CFR 668.43(a)(5)(v) requires an institution to make information about whether programs leading to professional licensure or certification meet educational requirements readily available to enrolled and prospective students. If an educational program is designed or advertised to meet educational requirements for a specific professional license or certification that is required for employment , the program is required to issue a “ general disclosure ” containing the following information: A. A list of all States for which the institution has determined that its curriculum meets the State educational requirements for licensure or certification; B. A list of all States for which the institution has determined that its curriculum does not meet the State educational requirements for licensure or certification; and C. A list of all States for which the institution has not made a determination that its curriculummeets the State educational requirements for licensure or certification. Licensure vs. Certification According to the U.S. Department of Education, the term “ licensure ” generally refers to an official process, administered by a state-level authority, which is required by law in order for an individual to practice a regulated profession. The term “ certification ” generally refers to a function administered by a non- governmental organization, which is intended to further recognize professional competence based on having met the quality standards of the organization. The prevalence and relevance of certification varies by profession. Professional Licensure Disclosures A professional licensure disclosure is a regulation of the U. S. Department of Education requiring all colleges and university to communicate publicly and directly to prospective and current students about: (1) educational programs that will or will not fulfill educational requirements for a specific professional licensure that is required for employment in that field; and (2) educational programs that meet or do not meet the education requirements for licensure for each state and U.S. territory regardless of the delivery mode of the program. 34 CFR 668.43(a) (5) (v) – General Disclosures The institution must make general disclosures for every state and territory when determining if the institution’s professional licensure, certification curriculum, or continuing education program meets the educational requirements of those states and territories. The rationale for this requirement is to supply information to students who are reviewing the institution, so the students can make informed decisions about

participating in the program. The fact that an institution does not have current students or incoming students from a specific state is irrelevant. Disclosures must be made for programs that lead to professional licensure for all modes of educational delivery. This includes distance education programs, hybrid programs, and face-to-face programs. For all modalities , disclosures must be made if the institution’s degree programs are: • "designed" to meet educational requirements for a specific professional license or certification that is required for an occupation, or • "advertised" as meeting professional licensure educational requirements in a state for that occupation. The institution should disclose its findings by creating: A. A list of states where the program curriculum meets state educational requirements for licensure or certification. B. A list of states where the program curriculum does not meet state educational requirements for licensure or certification. C. A list of states where the institution has not made a determination . 34 CFR 668.43(c) – Direct Disclosures The institution is required to issue an individualized “direct disclosure” to any prospective or current student in writing if the student is located in a State that falls within General Disclosure categories (B) or (C). In those two situations, the institution must inform the student directly of that status. For all modalities: • Prior to enrollment, students must be notified in writing (direct disclosure) if the program does not meet requirements OR if the institution has not made a determination of whether the program meets education requirements for licensure and/or certification in the state where the student is located. The regulations state “regarding the timing of these disclosures, the U. S. Department of Education (DOE) expects the institution will provide this disclosure before a student enrolls into a program or in the event that an institution does not provide an enrollment agreement before the student makes a financial commitment to the institution.” • If the student is enrolled in a program and the institution makes a determination the program does not meet educational requirements in the state where the student is located, the institution has 14 calendar days to notify the student in writing. • For a student currently enrolled in the program who notifies that institution they have relocated to another State, the program must provide a direct

disclosure to that student in writing, within 14 days of the relocation notice , if the student has relocated to a State that falls within categories (B) and (C) above.
Helpful Hint: Be sure to document that required direct notifications (pre- enrollment and/or address change) were sent. Ensure that a copy of the letter or email is kept within the student’s academic record. 34 CFR 600.9(c) – State Authorization • Upon request, the institution must document for the U. S. Department of Education (DOE) the disclosure process used by the institution to determine the licensure and certification programs and the process for identifying student location. • Each college must have a defensible process for maintaining and reporting professional licensure and certification disclosure. The process must include regular review of licensure and certification information (annual, bi-annual, etc.) and updating of webpage information. Institutional Location Policy Institutions are required to determine the states in which its students and prospective students are located for the purpose of disclosing state-specific professional licensure information. For purposes of issuing the required disclosures as to whether the institution’s educational program fulfills the professional licensure requirements, institutions shall establish a written process to determine a student’s location: • At the time a prospective student seeks information about an educational A. The institution must make a determination regarding the State in which a student is located in accordance with the institution's policies or procedures, which must be applied consistently to all students. B. The institution must, upon request, provide the U.S. Department of Education with written documentation of its determination of a student's location under paragraph (c) (3) (ii) (A) of 34 CFR 600.9, including the basis for such determination. C. An institution must make a determination regarding the State in which a student is located at the time of the student's initial enrollment in an educational program and, if applicable, upon formal receipt of information from the student, in accordance with the institution's procedures under paragraph (c)(3)(ii)(A)of 34 CFR 600.9, that the student's location has changed to another State. program leading to professional licensure; or • A student enrolls in such a program; and/or • An existing student notifies the institution of a change of address. The institution’s location policy should include, at minimum, the following:

CFR 668.43(c)(3)(iii) and CFR 600.9(c)(2)(ii) An institution must develop a defensible policy and process for determining the location of the student, including at the time of initial enrollment in a program and when there is any change of location as indicated by the formal receipt of information from the student. For examples of student location policies, please refer to Appendix H. Student Location Key Points • The institution must have a policy for determining student location. • The institution must have a policy for being notified when a student has relocated. • The data needs to be accessible for compliance reporting. • Practice across the institution MUST match the policy. • Institutions not knowing where the students are located is not an option. Responsibility of Students Colleges should encourage students to review the specific requirements for the program in which they are enrolling. This includes, but is not limited to, requirements related to practicum/internship as well as pre-qualifications for licensure such as the need for a criminal background check. Colleges should recommend that students contact the applicable licensure board(s) in their state of residence or in the state where they intend to obtain a license before beginning a program that results in licensure and prior to beginning any internship/practicum. Many licensure boards require more than successful degree completion to obtain a license. Please be advised that state laws, regulations, and policies may change at any time. Changes in requirements can impact the program's ability to meet educational requirements for licensure. After the community college has made all reasonable efforts to determine whether a program will meet state professional licensure requirements, it is the responsibility of the student completing the licensure program to check with the licensing board(s) in their state of residence or in the state in which they intend to obtain a license for the most current information and requirements. University Transfer Programs Many students attend a community college with the intent to transfer to a four-year college or university to complete their education. Although no licensure is required upon earning one of these degrees from a community college, some of the professions associated with these fields of study can require licensure once the student has earned a higher-level degree at the institution to which he/she has transferred. Such programs include, but are not limited to, accounting, education, and engineering. Colleges should encourage students to check with the four-year college or university about professional licensure for these university transfer programs.

State Authorization Reciprocity Agreement The State Authorization Reciprocity Agreement (SARA) is an agreement among member states, districts, and U.S. territories that establishes comparable nation-wide standards for interstate offering of postsecondary distance education courses and programs. The reciprocity agreement allows participating Mississippi colleges and universities to offer distance programs and courses to residents of member states without seeking state-by-state approval, and is intended to make it easier for students to take online courses offered by postsecondary institutions based in another state. SARA is overseen by a National Council (NC-SARA), and is administered by four regional education compacts. Important aspects of SARA • SARA is an agreement among U.S. member states, districts, and territories. • States join through their respective regional education compact. • Participation is voluntary for states and institutions. • Institutions operate and annually renew under the purview of their “Home State.” • SARA provides reciprocity for many out-of-state activities, but not all. National Council for State Authorization The National Council for State Authorization Reciprocity Agreements (NC-SARA) is the organization tasked with implementing SARA. NC-SARA was established to help expand students’ access to educational opportunities and ensure more efficient, consistent, and effective regulation of distance education programs. SARA participating institutions must meet certain requirements – many of which are focused on ensuring appropriate consumer protections for students. Key NC-SARA Student Consumer Protections include: • SARA institutions must be accredited. • SARA institutions must have U.S. oversight. • SARA institutions must demonstrate healthy finances. • SARA institutions are accountable for third-party providers. • SARA institutions must adhere to high standards. • SARA institutions must uphold stringent reporting and accountability requirements. • SARA institutions are required to have transparency around professional licensure. • SARA institutions must find ways to meet obligations to students. • Student complaints are taken seriously. • Compliance is non-negotiable.

State Portal Entity The State Portal Entity (SPE) is designated or appointed in each state to act as a liaison between the educational institution(s) and SARA. This office is responsible for updating the SARA member institutions on policy changes as it relates to the NC-SARA guidelines. The SPE is also responsible for the review and approval of the institutional SARA membership applications. Mississippi Commission on College Accreditation On November 2, 2015, the Southern Regional Education Board (SREB ) approved Mississippi as a member state to participate in the State Authorization Reciprocity Agreement (SARA), effective January 1, 2016. The Mississippi Commission on College Accreditation (MCCA) has been designated as the SPE for SARA. MCCA assumes the principal responsibility of ensuring that SARA policies are followed by the institutions they approve to participate in SARA. Institution participation is contingent upon approval and continued compliance under the agreement overseen by MCCA. Eligibility Requirements for Mississippi Institutions: • Be authorized to operate in Mississippi as an in-state postsecondary institution; • Be a degree-granting institution, awarding associate degrees or higher, accredited as a single entity by an accrediting agency recognized by the U.S. Department of Education, and whose scope of recognition, as specified by the U.S. Department of Education, includes distance education; • If not a public institution, document a federal financial responsibility composite score of at least 1.5 out of 3.0 on the USDE financial stability scale; and • Agree that, in cases where the institution cannot fully deliver the instruction for which a student has contracted, it will provide a reasonable alternative for delivering the instruction or reasonable financial compensation for the education the student did not receive. Helpful Hint: Be sure to document evidence of reasonable efforts, including website reviews, phone calls, and email correspondence, on the Professional Licensure Disclosure Template (Appendix E). For each program, the MCCB will create a comprehensive PDF that lists each of the states and territories for which determinations were made. SARA has indicated that all reasonable efforts consist of institutions researching the licensure requirements for each State where its students are located . If information is not readily available or clear, programs should then contact the relevant State licensing board for further information. If the licensing board is unresponsive or the requirements are still unclear, only then may the program disclose in good faith that it has not made a determination as to whether it meets licensure requirements in a particular State. Mississippi Community College Review Process All programs designed to or advertised as leading to licensure, regardless of modality, must create and distribute disclosure statements regarding whether the program does or does not lead to Licensure in each state within the United States and U.S. Territories. On April 12, 2022, the Mississippi community colleges agreed to collaborate, where applicable, to reduce duplication of effort and to ensure system-wide compliance with federal laws, regulations, and the State Authorization Reciprocity Agreement. The following section outlines the programs that have been identified as leading to licensure in the State of Mississippi, denotes which college will serve as the lead reviewer for disclosure statements, and sets forth the responsibilities of the MCCB and the community colleges for collaboration purposes. Community College Programs Leading to Licensure Mississippi’s community colleges offer many programs leading to professional licensure. A comprehensive listing of community college programs leading to licensure, including SARA’s Impact on Programs Leading to Licensure Any Institution approved to participate in SARA that offers courses or programs designed to lead to professional licensure or certification or advertised as leading to Licensure must satisfy all federal requirements for disclosures regarding such professional licensure programs under 34 §C.F.R. 668.43 . For SARA purposes, institutions unable, after all reasonable efforts , to determine whether a program will meet state professional licensure requirements shall provide the student or applicant with current contact information for any applicable licensing boards , and advise the student or applicant to determine whether the program meets requirements for licensure in the State where the student or applicant is located.

which colleges offer each program, as well as which college will serve as lead reviewer, is located in the Professional Licensure Canvas course under the Sharing Circle Module. Timeline Upon request by the U.S. Department of Education or MCCA SARA, the institution must provide the disclosure process used to determine the licensure and certification requirements and the process for identifying student location. Each college must have a defensible process for maintaining and reporting professional licensure and certification disclosure. The process must include regular review of licensure and certification information and updating of webpage information. Mississippi’s community colleges, in conjunction with the MCCB, will adhere to the following annual review process. February: Licensure Program Liaison and SARA Applications • The MCCB will prepare a Licensure Program Liaison (hereinafter referred to as Liaison) spreadsheet (Appendix A) where colleges will self-identify the individual who will serve as the college’s Liaison and primary point of contact for the purpose of collaborating on professional licensure compliance. • Each college will list the individual to represent its college to receive and respond to correspondence related to the professional licensure review process. The Liaison will be responsible for disseminating information related to professional licensure to the applicable members of his or her institution. The MCCB recommends that a specific position be identified as the point of contact for instances of personnel changes. • The Liaison will prepare a list of programs leading to licensure (Appendix B) for their institution. The list should include the CIP Number . • MCCA SARA applications are due to the State Portal Entity (SPE) designee. Once all 15 applications have been received by the SPE, the MCCB will receive an invoice and issue payment to the MCCA on behalf of the institutions. March: Updates and Program Lead Assignments • The MCCB will request that each college’s Liaison submit the list of programs that lead to licensure for their college via a Canvas course assignment upload. • The MCCB will compile the list of programs that lead to licensure into one document and distribute it to the Liaisons for validation and review. • The MCCB will update the Professional Licensure and Compliance Canvas Course. • Preferably in conjunction with the Creating Futures through Technology Conference, the MCCB will host a Professional Licensure and State Authorization Compliance Meeting. o The MCCB will provide applicable updates relating to professional licensing and state authorization.

o Each college will select 2-3 programs (depending on number of programs on comprehensive list) to serve as the lead reviewer for disclosure statements. o The colleges will review and approve sample templates of disclosure statements (Appendix C). o The colleges will review and approve sample Licensure Board email templates (Appendix D). • The MCCB will provide guidance, including a tutorial, on how to submit the Professional Licensure Disclosure forms which will be due by June 1 st of each year. April: NC-SARA Applications • The colleges will submit a PDF copy (or forward the NC-SARA email with the link to PDF) to the MCCB Assistant Executive Director for eLearning & Instructional Technology. • Once the MCCB has received all 15 PDF invoices for NC-SARA, payment will be issued. • Once NC-SARA has processed payment, the colleges will be considered renewed for the year. (May to May renewal cycle) June 1 st : Professional Licensure Disclosure Form • The MCCB Professional Licensure Disclosure template (Appendix E) is due for each program, by state and territory, by the lead reviewer college. The Liaison will submit the completed forms in the Professional Licensure and Compliance Canvas course: o Only the Liaison will have access to submit the completed forms. o The completed forms will be submitted by program as one (1) combined PDF document for all states and territories. o The Liaison should ensure all 50 states and territories are included prior to submission. August 1 st : General Disclosures • The MCCB will utilize the information from the Professional Licensure Disclosure form to complete the following: o Create a Professional Licensure Disclosure by State form (Appendix F) for each program. o Create a Licensing Board Contact List spreadsheet for each program. o Update the MCCB Professional Licensure Compliance webpage(s). Colleges will be provided with the URL to hyperlink to local webpages. o Create Flipping Books, which will be housed in the Professional Licensure and Compliance Canvas course, for each of the programs leading to licensure for college documentation compliance purposes. o The MCCB will notify the Liaisons when the aforementioned items have been completed.

Definitions • Certification: Refers to a function administered by a nongovernmental organization, which is intended to further recognize professional competence based on having met the quality standards of the organization. The prevalence and relevance of certification varies by profession. • Current Students: Students who are currently enrolled at a Mississippi community college. • Licensure Program Liaison: Serves as the college’s primary point of contact for Professional Licensure and State Authorization compliance, provides information and documentation, and is responsible for submission uploaded in Canvas. • Licensure: Refers to an official process, administered by a state-level authority that is required by law in order for an individual to practice a regulated profession. • Location Policy: An institution must develop a defensible policy and process for determining the location of the student, including at the time of initial enrollment in a program and when there is any change of location as indicated by the formal receipt of information from the student. • Location: The state in which the student is located while participating in a Mississippi community college educational program. • Professional Licensure Disclosure: The U. S. Department of Education requires all colleges and universities to communicate publicly and directly to prospective and current students by providing them with a professional licensure disclosure about: o Educational programs that will not fulfill educational requirements for a specific professional licensure that is required for employment in that field; and o Educational programs that do not meet the education requirements for licensure or for which an institution cannot determine if the program meet the educational requirements for each state and U.S. territory for all delivery modes of the program. • Professional Licensure Program: A program customarily leading to licensure is an educational program offered by institutions of higher learning designed, marketed, and/or advertised to meet educational requirements: o For a specific license or certification; and o Is required for employment in an occupation. • Prospective Students: Students who have applied for admission to a Mississippi community college, but who have not yet enrolled. • Residence: The state in which the student has legal residence. • SARA : State Authorization Reciprocity Agreement. • State Portal Entity: The entity that is designated or appointed in each state to act as a liaison between the educational institution(s) and SARA. Applicability. This policy applies to academic programs leading to professional licensure and/or certification. This policy is written to comply with regulatory and accreditation requirements including the Higher Education Act and related regulations, Southern Association of College and Schools Commission on Colleges, and the State Authorization Reciprocity Agreement. Policy Statement and Purpose. This policy describes the process for TCU to discharge its obligations under federal law and regulations, accreditation requirements, and the State Authorization and Reciprocity Agreement: • to make a good faith effort to determine if its Professional Programs meet the educational prerequisites for Licensure for each state and territory in the United States; and • to disclose to students enrolled in its Professional Programs whether its Professional Programs meet educational prerequisites for Licensure in the state or territory where the student engages in educational activities. Policy Definitions. A. Professional Program(s): An academic or degree program at TCU that prepares a student to practice in a field that may require Licensure to practice in a particular state or US territory. B. Licensure: An official process administered by a state-level or territory-level authority that is required by law for an individual to practice a regulated profession in that state or territory. C. Professional Licensure Disclosures: the disclosures by TCU to students and prospective students concerning whether a Professional Program meets educational prerequisites for Licensure or Certification of the various states and US territories. The timing and manner of the disclosures and the information included in the disclosures are described in this policy. EXAMPLE POLICY
